Terms and Conditions – Top Tier Exclusive Car Transport

1. General Provisions

1.1. These Terms and Conditions ("Terms") apply to all transport services provided by Top Tier Exclusive Car Transport ("the Company").
1.2. By booking a transport service with the Company, the Customer agrees to these Terms.
1.3. The Company reserves the right to amend these Terms at any time, with notice provided to the Customer.

2. Booking and Scheduling

2.1. Bookings must be made at least 48 hours before the requested transport date.
2.2. Emergency transport services are available at an additional charge, subject to availability.
2.3. All bookings must include accurate details of the vehicle(s) or items to be transported, pickup and delivery locations, and any special handling requirements.

3. Pricing and Payment

3.1. All prices are based on distance, vehicle type, and any additional requested services. Special requests or requirements may incur additional costs.
3.2. Quotes will be provided to the Customer in advance, and prices are valid for 14 days from the date of the quote.
3.3. Payment is due via bank transfer after transport is completed unless otherwise agreed.
3.4. Prices are exclusive of VAT and any other applicable taxes.
3.5. Payments can only be made through bank transfer to the Company’s designated bank account.
3.6. Late payments may incur additional charges or interest.

4. Cancellation Policy

4.1. Cancellations made more than 24 hours before the scheduled transport incur a 25% cancellation fee.
4.2. Cancellations made less than 24 hours before transport incur a 50% cancellation fee.
4.3. Cancellations on the day of transport will require full payment of the agreed transport fee.

5. Condition of Vehicles and Items

5.1. The Company will document the condition of all transported vehicles/items through video evidence before and after transport.
5.2. The Company is not responsible for pre-existing damage, hidden defects, or mechanical failures.

6. Insurance Coverage

6.1. The Company provides basic insurance for transported vehicles/items.
6.2. Customers may request additional insurance, either through the Company or an external provider.
6.3. The Company is not responsible for any damage beyond the coverage of the provided insurance.

7. Transport and Delivery

7.1. The Company will make reasonable efforts to deliver vehicles/items on time but is not liable for delays due to traffic, weather, mechanical issues, or unforeseen circumstances.
7.2. In case of vehicle breakdown during transport, the Company will arrange an alternative transport solution as soon as possible.
7.3. If the recipient is unavailable at the delivery location, the vehicle/item may be returned to the nearest safe location, and additional storage and re-delivery fees may apply.

8. Non-Operational Vehicles & Special Handling

8.1. If a vehicle is non-operational (e.g., no keys, mechanical failure), additional handling fees may apply.
8.2. Customers must disclose if a vehicle has specific handling requirements before transport.

9. Missed Delivery Attempts

9.1. If a delivery cannot be completed due to the customer’s absence, a re-delivery fee will be charged.
9.2. The Company is not responsible for any costs incurred due to missed deliveries.

10. Liability and Limitations

10.1. The Company is not liable for minor scratches, stone chips, or dirt accumulated during transport.
10.2. The Company is not responsible for personal belongings left inside the vehicle.
10.3. Liability is limited to the value covered by the insurance provided.

11. Force Majeure

11.1. The Company is not responsible for delays or failures due to events beyond its control, including but not limited to accidents, extreme weather, strikes, or government restrictions.

12. Dispute Resolution

12.1. The Company and Customer will attempt to resolve disputes amicably before taking legal action.
12.2. Any legal disputes shall be governed by the laws of the Netherlands.

13. Storage Fees

13.1. If a vehicle/item is not collected after transport is completed, storage fees will apply.
13.2. The Company is not responsible for any damages incurred while the vehicle/item is in storage.

14. Amendments and Final Provisions

14.1. The Company may update these Terms at any time.
14.2. The latest version of these Terms will always apply to transport services.

15. Customer Consent for Transport

15.1. The Customer authorizes the Company to transport the vehicle and agrees that they are responsible for ensuring all required paperwork and documents are provided for the transport.
15.2. The Customer confirms they have obtained consent from the vehicle owner, if different, for the transport service.

16. Right to Refuse Transport

16.1. The Company reserves the right to refuse transport of any vehicle that does not meet the Company’s safety or suitability standards, including vehicles with undisclosed damage, mechanical issues, or those unsuitable for transport.

17. Customer Contact Information

17.1. The Customer is responsible for ensuring their contact information is correct and up-to-date. Any changes to the contact information should be communicated to the Company in a timely manner.

18. Customs and Import/Export Regulations

18.1. The Customer is responsible for ensuring that all customs regulations and paperwork for the vehicle are completed for any international transport.

19. Right to Modify Services

19.1. The Company reserves the right to modify or adjust the transport services provided (e.g., change of route, transport method) in the case of unforeseen circumstances or challenges, without incurring additional liability.

20. Termination of Service

20.1. The Company reserves the right to terminate the service if the Customer fails to make the required payment, breaches any of the Terms, or provides inaccurate or incomplete information.

21. Customer's GDPR Rights and Data Usage

21.1. The Company complies with the General Data Protection Regulation (GDPR) and ensures that customer data is handled with the utmost confidentiality and used only for purposes related to transport services.
21.2. The Company may use photographs of the transported vehicles (excluding license plates) for promotional purposes, with the Customer's consent.

22. Consumer Protection Rights

22.1. Customers, as consumers, are entitled to certain rights under EU consumer protection laws, including the right to cancel services under specific conditions.

By booking transport with Top Tier Exclusive Car Transport, the Customer confirms they have read, understood, and agreed to these Terms and Conditions.
